1. About KH Ergo & Wellness

KH Ergo & Wellness is an ergonomics training and consulting company founded and operated by Krys Hines, PT, DPT, MBA, a licensed Doctor of Physical Therapy and Certified Ergonomics Assessment Specialist. We provide ergonomics training programs, self-assessment platforms, physical therapist-led assessments, interactive wellness workshops, conference speaking, and organizational workspace design consulting to businesses and organizations nationwide.

These Terms govern your use of our website at khergowellness.com and any services you engage through that website or subsequent agreements.

2. Acceptance of Terms

By using this website or engaging our services, you confirm that:

• You are at least 18 years of age or are accessing the website on behalf of an organization with authority to bind that organization to these Terms

• You have read, understood, and agree to be bound by these Terms and our Privacy Policy

• If you are entering into these Terms on behalf of a company or organization, you have the legal authority to do so

 

These Terms apply to website visitors, prospective clients, and existing clients. Formal service engagements are additionally governed by a separate written service agreement or proposal, which takes precedence over these Terms in the event of any conflict.

3. Services

KH Ergo & Wellness offers the following categories of services:

Scalable ergonomics training

On-demand and live training programs for employees and leadership teams, delivered individually or as part of an organizational rollout. Delivery formats include self-paced online courses, live virtual workshops, in-person sessions, and hybrid models.

​

Configurable self-assessment web application

A digital platform for computer-based workers that provides guided workspace self-assessments, integrated access to training content, customizable equipment recommendations, and management-level reporting dashboards.

 

Physical therapist-led ergonomic assessments

In-person or virtual workstation assessments conducted by licensed physical therapists. These assessments are educational in nature and are designed to teach body awareness, proper equipment adjustment, and self-management strategies. They do not constitute medical treatment, diagnosis, or a therapeutic patient-provider relationship.

Interactive workspace education workshops

Group workshops covering workspace setup, movement integration, body awareness, mindfulness, productivity, and the psychosocial dimensions of workplace wellness.

 

Conference speaking and keynotes

Presentations for conferences, corporate events, and organizational meetings on topics including ergonomics, musculoskeletal health, workplace performance, and movement for desk workers.

 

Organizational workspace design consulting

Advisory consulting on office layout planning, equipment procurement strategy, furniture and technology selection, and vendor evaluation to align physical environments with ergonomic training principles.

 

The specific scope, deliverables, timeline, and fees for any service engagement will be defined in a separate written proposal or service agreement. No service commitment is created by use of this website or submission of an inquiry form.

 

4. Not Medical Advice

Important: The content on this website, in our email communications, in our training programs, and in our resources is provided for educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment.

Our physical therapist-led assessments are educational workplace assessments, not clinical evaluations or therapeutic treatment. No patient-provider relationship is created between KH Ergo & Wellness and any individual as a result of a workstation assessment or any other service.

If you or your employees are experiencing pain, injury, or physical symptoms, you should seek evaluation and treatment from a licensed healthcare provider. Our services are designed to complement, not replace, appropriate medical care.

Organizations should not use our training programs or assessments as a substitute for medical evaluation of injured or symptomatic employees.

5. Website Use and Acceptable Conduct

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the website by, any third party.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website or our services without our prior written consent.

Limited license for personal use

Resources downloaded from our website (such as our ergonomic checklist) are provided for your personal or internal organizational use only. You may share them internally within your organization but may not redistribute them publicly, sell them, or present them as your own work.

Client deliverables

Upon full payment for a service engagement, clients receive a limited license to use deliverables (such as training materials or assessment platforms) as specified in their service agreement. Ownership of all underlying intellectual property, including course content and methodologies, remains with KH Ergo & Wellness unless otherwise explicitly agreed in writing.

 

7. Free Resources and Lead Magnet Materials

From time to time, we offer free downloadable resources in exchange for your email address. By downloading a resource, you agree to receive follow-up email communications from KH Ergo & Wellness. You may unsubscribe at any time using the link included in every email or by contacting us at info@khergowellness.com.

Free resources are provided as-is for informational and educational purposes. We make reasonable efforts to ensure accuracy but make no warranties regarding the completeness or applicability of free resource content to your specific situation.

 

8. Testimonials and Outcome Data

Testimonials and outcome statistics presented on our website (including reductions in helpdesk requests, resolution times, and musculoskeletal disorder rates) are based on data from client organizations that implemented comprehensive training and self-assessment programs over 12–24 month periods. These results are illustrative of what is possible and are not a guarantee of specific outcomes for any individual organization.

Results will vary depending on organizational size, existing programs, employee engagement, implementation fidelity, and other factors. KH Ergo & Wellness makes no warranty that any specific outcome will be achieved.

 

9. Fees, Payment, and Cancellation

Fees for services are outlined in individual proposals and service agreements. General terms that apply unless otherwise specified in a written agreement include:

• A signed proposal or service agreement and deposit payment are required before work commences on any engagement

• Invoices are due within 30 days of issuance unless otherwise agreed in writing

• Cancellation of a scheduled workshop, assessment, or speaking engagement with less than 14 days’ notice may result in forfeiture of the deposit or a cancellation fee, as specified in the applicable service agreement

• Rescheduling requests made with more than 14 days’ notice will be accommodated at no charge, subject to availability

• All fees are in US dollars

 

Specific cancellation, refund, and rescheduling terms are governed by the written service agreement for each engagement. Nothing in these Terms creates an obligation for KH Ergo & Wellness to enter into a service agreement with any party.

 

10. Confidentiality

KH Ergo & Wellness understands that client organizations may share sensitive information during engagements, including information about employee health concerns, internal processes, and organizational challenges. We treat all such information as confidential and will not share it with third parties except as required by law or as necessary to deliver services.

Clients may request a mutual non-disclosure agreement (NDA) prior to any engagement. Please raise this during the consultation process.

Aggregate, anonymized data from client engagements (such as outcome statistics) may be used for marketing and educational purposes, with no identifying information included.

11. Limitation of Liability

Please read this section carefully. It limits the circumstances under which KH Ergo & Wellness may be held liable.

To the fullest extent permitted by applicable law, KH Ergo & Wellness, its founder, employees, contractors, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services

• Any injury, illness, or physical harm arising from the application of information provided on this website, in training materials, or during assessments, where such application was inconsistent with the guidance provided or occurred outside the scope of our services

• Any business loss, including loss of revenue, profits, data, or goodwill, arising from use of or reliance on our services or website content

• Any interruption, suspension, or termination of website access

 

Our total aggregate liability to any client or website user for any claim arising out of or in connection with these Terms or our services shall not exceed the total fees paid by that client in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Any dispute arising out of or in connection with these Terms or our services that cannot be resolved informally shall first be submitted to non-binding mediation before either party initiates formal legal proceedings. The parties agree to participate in mediation in good faith before pursuing litigation.

Any legal proceedings not resolved through mediation shall be brought exclusively in the state or federal courts located in Arlington County, Virginia. You consent to the personal jurisdiction of those courts.

For users located in the European Economic Area, nothing in these Terms affects your statutory rights under applicable consumer protection law.
